A High Court Advocate, U Ohn Maung, said some publications refer all the people arrested, while travelling without legal identification papers, are termed as Bengali, which he said provoke racial hatred. In an incident on 27 October in Myeik Township, three Muslim women from Yangon were arrested at a guesthouse on suspicion of breaching the Registration Act 29 (1) and they were charged by the Immigration Department under the sections 6(2) and 6(3) of the Registration Act for the People living in Myanmar. They were arrested for not having proper identification papers while staying in Tein Hlwa Tun guesthouse. The incident was reported in the Myeik District News and Crime Media that the three arrested women were illegal Bengali immigrants. “People need to understand what the meaning of illegal immigrants is. It is generally means those who came into Myanmar illegally crossing the border. There are many such border posts in Myanmar, but the attention is placed only on the western border. However, at the eastern side of the border, people are coming in at their will. By mentioning illegal immigrant with Bengali tends to indicate that all illegal immigrants came to Myanmar are Bengalis,” U Ohn Maung said. He said those who were arrested could be the people whose citizenship identification cards must be expired or could be those who application for the citizenship identification card is still under processing. He added that the authorities should find out on the detail facts before they indict them. If the three women were found guilty under the charges they are put on trial, they could get two years rigorous imprisonment or the same years of imprisonment without hard labor or fine not more than Kyat 500 or both the imprisonment and the fine.
